1. Formation of Agreement

1.1 This agreement becomes effective once the applicant confirms acceptance during the sign-up process or signs physically at our reception desk.

1.2 Membership applications are subject to review, and Spartan Martial Arts & Fitness reserves the right to approve or decline any application without providing justification.

1.3 Membership activation begins immediately upon successful payment unless joining during pre-opening, in which case activation begins on the official opening date of the facility.

1.4 Upon activation, the member receives access according to the membership category selected.

1.5 Memberships are personal to the member and are non-transferable.

2. Governing Law & Jurisdiction

2.1 These Terms & Conditions are governed by the laws of the United Arab Emirates.

2.2 Any dispute shall fall under the jurisdiction of UAE courts with appropriate authority.

2.3 Spartan Martial Arts & Fitness does not provide services to OFAC-restricted or sanctioned countries.

2.4 Users accessing our services or website from outside the UAE are responsible for complying with local regulations.

3. Member Health & Fitness Declaration

3.1 By entering this agreement, the member confirms they are medically fit to participate in physical exercise and have no condition that may put themselves or others at risk.

3.2 Individuals with any medical concerns, chronic conditions, or prescribed medication that may affect exercise must provide a physician's clearance.

3.3 Members must not use the gym while suffering from contagious illnesses, open wounds, infections or conditions that may jeopardize others.

4. Membership Fees & Financial Terms

4.1 A one-time registration fee may apply at the point of joining. This covers administration and onboarding services.

4.2 Spartan Martial Arts & Fitness may offer promotional periods where fees are reduced or waived at our discretion.

4.3 Membership fees are payable by secure online payment, debit/credit card, or approved payment channels.

4.4 Members are responsible for ensuring their personal and billing information remains current and accurate.

4.5 Transaction records must be retained by the member for future reference.

4.6 Although data security measures are implemented, electronic transmission cannot be guaranteed as fully secure.

4.7 Our website Terms & Conditions and Privacy Policy may be updated periodically without prior notice. Members are encouraged to review updates regularly.

5. Payment & Billing Responsibility

5.1 We accept Visa/Mastercard (credit & debit) in AED.

5.2 All online payments remain subject to third-party processor terms.

5.3 The member is responsible for safeguarding their login, payment details, and personal account access.

6. Cancellation & Refund Policy

6.1 Online sign-ups are eligible for cancellation within 14 days, provided the member has not accessed the club. If they have accessed the club once during this period, cancellation must be requested within 24 hours of first entry.

6.2 In-person sign-ups inside the club are not eligible for a statutory cooling-off period.

6.3 Refunds, when applicable, are returned through the original payment method within 7–14 business days (bank-dependent).

6.4 Cancellation requests must be submitted through the official contact portal on our website; requests made via phone, WhatsApp, verbal instruction or social media are not valid.

6.5 Submission of a cancellation request does not mean automatic approval. Confirmation will be provided via email/WhatsApp/SMS within 72 hours.

7. Membership Freezing

7.1 A 4-month membership may include 1 complimentary freeze month, 12-months memberships may include 2 complimentary freeze months.

7.2 Freeze requests must be communicated in advance via WhatsApp or reception.

7.3 Frozen membership periods do not count toward contract completion. Minimum-term commitments resume after reactivation.

7.4 No facility access is permitted during freeze status unless re-activating proceed.

8. Data Protection & Communication Consent

8.1 Members acknowledge and accept our Privacy Policy upon registration.

8.2 Facility photos and promotional media may occasionally capture members incidentally.

8.3 We may contact you using the details provided for operational, billing, marketing, and service-related updates unless you request otherwise.

9. Health, Safety & Facility Use

9.1 A medical certificate may be requested prior to training.

9.2 Members must maintain hygiene standards, sanitize equipment after use, and carry a workout towel.

9.3 All equipment must be returned to designated storage areas after use.

9.4 If a member is unsure about equipment, they must seek staff guidance—incorrect use may result in being asked to stop for safety reasons.

9.5 The gym operates a strict no-smoking, no-alcohol, and no-drugs policy.

9.6 Members train at their own risk; any malfunction or safety concern must be reported immediately.

10. Conduct & Behaviour

10.1 Respectful behaviour is mandatory toward staff, members, guests, and property.

10.2 Threatening or abusive conduct may result in immediate termination of membership with no refund of fees.

10.3 Management retains the right to deny access to anyone behaving inappropriately.

10.4 Anti-social conduct, harassment, or rule violations may result in eviction and contract cancellation.

10.5 Complimentary membership holders are bound by the same rules and may have privileges revoked if misused.

11. Facilities, Recording & Personal Property

11.1 Spartan Martial Arts & Fitness is not responsible for lost, stolen, or damaged personal items anywhere on-site.

11.2 Recording individuals without their consent is prohibited; respect personal privacy at all times.

12. General Membership Conditions

12.1 Members must be 18+. Those under 18 may only join with signed parental/legal guardian consent.

12.2 Membership may be terminated instantly if terms, rules, safety policies, or behavioral standards are breached.

12.3 Personal training, coaching services, or product sales may not be conducted privately inside the facility.

12.4 Reproducing or distributing gym designs, branding, training material, theme, or media is strictly prohibited.

12.5 Members who engage an external personal trainer may only bring such trainer into the facility if the trainer has been formally registered with Spartan Martial Arts & Fitness and holds an active membership or approved access permit. Unauthorized external trainers are strictly prohibited from entering or conducting any training activities within the premises.

13. Liability Limitation

13.1 Members acknowledge that physical exercise involves inherent risk.

13.2 Spartan Martial Arts & Fitness is not liable for injury, loss, or property damage unless caused by proven negligence.

13.3 Our total liability shall not exceed the value of one annual membership.

13.4 This clause does not limit consumer rights protected under UAE law.

14. Arrival & Collection (For Minors in Programs)

14.1 Kids members must arrive on time to complete warm-up safely.

14.2 Parents/guardians must collect their children promptly after sessions.

14.3 Movement inside the gym during classes must be minimized to ensure safety and training quality.
